Terms of Use

This Terms of Use ("Terms") governs your access to and use of the mobile game Seagull Soup, developed and operated by Nanjing Shitu Cloud Technology Co., Ltd. (“Company”, “we”, “us”). By downloading, accessing, or using Seagull Soup (the "App"), you agree to these Terms in full.

1. Eligibility

You must be at least 13 years old (or the age of digital consent in your country) to use the App. By using the App, you confirm that you meet this requirement.

2. Account and Game Progress

• To save your game progress across devices, you must log in using supported methods (email, Apple ID, Google account, etc.).
• Playing as a guest stores progress locally. This progress will be lost if you uninstall the App or switch devices.
• You are responsible for maintaining the confidentiality of your login credentials. We are not liable for unauthorized access caused by your actions or negligence.

3. In-App Purchases

The App offers optional in-app purchases (IAP), including virtual items such as points, puzzle unlocks, hint cards, or visual elements. By making a purchase, you agree to the following:

• All purchases are final and non-refundable, except where required by law or platform policy.
• Virtual goods have no monetary value outside the App and cannot be traded, resold, transferred, or redeemed for real money.
• Prices and availability of virtual items may change without prior notice.
• Your transaction is processed by the app store (Apple App Store or Google Play). We do not access or store payment details.

4. Data Usage and Privacy

By using the App, you agree to the collection and use of your data as outlined in our Privacy Policy. Key data handling principles include:

• Data collected may include gameplay behavior, device type, and account info (if logged in).
• Guest data is stored locally; cloud sync requires login.
• We may use analytics and crash reporting tools (e.g. Firebase) to improve app performance.
• We do not sell your personal information.

5. Advertising and Third-Party Services

The App may display advertisements served by third-party networks such as AppLovin, Google AdMob, or Meta Audience Network. These services may collect anonymized identifiers (e.g., ad ID, IP address, behavioral patterns) to provide targeted ads. We do not control or endorse the content of third-party ads.

You can opt out of personalized ads through your device settings (Limit Ad Tracking).

6. User Conduct

You agree not to:

• Use cheats, automation tools, or unauthorized third-party software
• Disrupt the gameplay experience for others
• Violate any applicable laws, including intellectual property and privacy laws
• Exploit bugs or reverse engineer the App

We reserve the right to suspend or terminate your access without notice if we suspect abuse or violation of these Terms.

7. Intellectual Property

All game content, including but not limited to puzzle content, UI design, graphics, characters, and logic systems, is owned by or licensed to Nanjing Shitu Cloud Technology Co., Ltd. and protected under copyright and trademark laws. You may not copy, modify, or redistribute any part of the App without written permission.

8. Virtual Items & Service Availability

• We reserve the right to modify or remove any in-game items, features, or balance without compensation.
• We do not guarantee uninterrupted access or permanent availability of the App or your data.
• We are not liable for the loss of data due to device failure, uninstalling, or failure to log in.

9. Termination

We may terminate or restrict your access at any time without notice for violations of these Terms, suspected cheating, or illegal behavior. You may also delete the App at any time. Account and purchase data may be deleted after prolonged inactivity (e.g., 12+ months).

10. Disclaimers

The App is provided “as is” and “as available” without warranty of any kind. We do not guarantee that:

• The App will be free from bugs or interruptions
• The puzzles will meet your personal preferences or expectations
• Gameplay data will always be recoverable

To the extent permitted by law, we disclaim all implied warranties and will not be liable for indirect or consequential damages.

11. Governing Law and Jurisdiction

These Terms are governed by the laws of the People’s Republic of China. Any disputes arising from these Terms or the use of the App shall be subject to the exclusive jurisdiction of the courts located in Nanjing, China, unless otherwise required by applicable local law.

12. Changes to Terms

We may update these Terms from time to time. Continued use of the App after any changes constitutes acceptance of the new terms. We encourage you to review these Terms periodically.
